Terms and Conditions of Service

These Terms and Conditions of Service, last updated on January 1, 2022, constitute the complete and full Service Agreement between the Customer and www.divinacleaningservices.com (collectively, "Company," "we," or "us"). By engaging www.divinacleaningservices.com for recurring or one-time services, the Customer agrees to the following Terms and Conditions of Service

Residential Services

Subject to the terms of this Agreement, www.divinacleaningservices.com agrees to provide Services to the Customer at an address specified by the Customer and for tasks mutually agreed upon by both parties at the time of the Appointment Request.

If the Customer requires any changes to the Service to be provided or any additional services or variations while the Service is being performed, the Customer must first contact www.divinacleaningservices.com by phone, which may agree to provide the additional services or changes at its sole discretion. Workers are not authorized to agree to any changes to the Service being provided unless other arrangements have been made with www.divinacleaningservices.com.

www.divinacleaningservices.com will provide one or more workers, including subcontractors, to faithfully, diligently, and in a timely and professional manner, service the Customer's Home and/or Office at a mutually agreed-upon time and date between www.divinacleaningservices.com and the Customer.

Customer Representations and Warranties

The Customer represents and warrants that:

1. They will provide a safe working environment on the premises for the workers to perform the Services.

2. Workers will have free and unobstructed access to the areas of the Facilities that require the Services.

3. They will provide Workers access to all necessary services and utilities (including hot and cold water, electricity, and trash receptacles) as required by Workers to provide the Service.

4. They will provide all usual and necessary equipment and materials required by Workers to provide the Service, unless other arrangements have been made with the Company.

5. All equipment and materials provided by the Customer are safe, unaltered, and in perfect working condition.

6. They will inform www.divinacleaningservices.com before the start of the Service of any hazards, slippery surfaces, risks, or dangers, rooted dirt, grease, or dirt on the Premises.

7. They are authorized to use the Premises and obtain the provision of the Service.

8. If the Customer requires Workers to perform services behind or under any heavy items (e.g., a refrigerator, bookshelf, or other furniture), they will move these items before the start of the Service.

9. They will protect or remove any fragile, delicate, breakable, or partially broken items, valuable items, including money, jewelry, artwork, antiques, or items of sentimental value before the start of the Service.

No Engagement of Workers

The Customer acknowledges that www.divinacleaningservices.com invests significant resources in recruiting, selecting, and training its Workers. Unless www.missandmrcleaninglocal.com gives prior written permission, the Customer must not directly or indirectly hire, employ, or contract any Worker to provide Residential or Office Services to the Customer or any associate of the Customer for any period during which services are provided by www.divinacleaningservices.com or for a period within 24 months after the completion of any Service.

 

The Customer acknowledges that www.divinacleaningservices.com may suffer losses and damages, including, without limitation, consequential loss, as a result of a breach of this clause by the Customer. If the Customer wishes to hire a current or former worker of www.divinacleaningservices.com for any home-related service outside of the Customer's agreement with www.missandmrcleaninglocal.com, www.missandmrcleaninglocal.com may be entitled to a Referral Fee of $5,000. This fee is due within 30 days of notification by www.missandmrcleaninglocal.com. If the fee is not paid, wwww.divinacleaningservices.com reserves the right to pursue other methods of collection, including legal action.

Service Fees, Online or Phone Quotes, and Promotional Offers

Any price quoted by our Instant Online Quotation System or by Phone is estimated only. This estimate is based on the Company's experience, without inspection and based on the information provided by the Customer. These quotes are subject to inspection and/or evaluation for final pricing.

The Customer understands that, unless otherwise agreed between the parties, the Service Fee will be based on a fixed rate and limited to a certain number of Man-Hours allocated for the service. Additionally, the Service Fee also takes into account all Cleaning Tasks and the condition of the house described by the Customer.

www.divinacleaningservices.com reserves the right to allocate as many service workers as it deems necessary. The allocation of personnel is based on many different conditions, including the number of jobs for the day, the type of house, the size of the house, the location of the property, and so on.

If at the start or during the provision of the Services, it becomes evident that the actual cost of the Service will exceed the quote provided by www.divinacleaningservices.com, we reserve the right to offer the Customer the option to pay an increased fee to complete the Services or pay the quoted amount without the Service being completed. In any case, if the service exceeds the previously negotiated allocated time, an overtime fee of no less than $32.00 per man - hour, charged in minute increments, will be assessed and billed as soon as the service is completed. This additional Service Fee may vary depending on the Customer's location and/or Service Address.

Quoted rates for recurring services are determined based on the type of property, size, number of bedrooms, bathrooms, and some other details. Our online tool can provide an estimate but cannot confirm or be proof of any commitment, as a final in-home assessment would be required before any commitment. Additional Services

Additional services are provided at an extra cost and include carpets, window and wall washing, steam cleaning of hard surfaces, internal cleaning of ovens and refrigerators, hand dishwashing, green or eco-friendly cleaning, sweeping of garage glass doors (additional), basement cleaning, fireplace ash removal and cleaning, grout cleaning, trash removal, and other services. Restrictions apply to chandelier cleaning.

Cancellations or Rescheduling

Cancellation or rescheduling requests must be addressed directly to a company representative, by phone, text message, or email. Such requests must also be made outside of a 48-hour window before the scheduled service date. In the event the Customer fails to comply with this provision, the Customer agrees to pay a Cancellation and/or Rescheduling Fee of 50% of the agreed-upon Service Fee and not less than $72.00, whichever is higher. This fee will be assessed to the Customer's account, including Customers who have a Promotional Voucher or Gift Card, where the cancellation will be assessed against its paid value, rendering the voucher or Gift Card void or invalid. The Customer agrees to pay this fee as part of the Company's administrative costs and losses.

Payment Terms and Refunds

Unless other arrangements have been made, payments are due at the time of scheduling or service request. Scheduling can be done through the Company's Web Interface or by phone with a Company Customer Service Representative. All payments are fully refundable as long as the refund request is made outside of 48 hours from the start of the Service. As described in the Cancellation or Rescheduling Request provision, failure to comply with this provision may result in an additional Late Fee of $15.00. This fee will be assessed to the Customer's account and will be due immediately.

 

A $25 fee will be assessed for all returned checks unpaid due to cancellation or insufficient or unavailable funds. A $25 fee will be assessed for all monies due to the Company that must go to our collection office.

Customer Complaints

Any complaints or notices regarding the service performed by the Company must be reported to the Company within 24 hours from the date the service was completed to be valid and considered. These reports can be initiated online through our Web Interface at www.divinacleaningservices.com or emailed to wdivinacleaningservices@gmail.com to record such a report. Please note that any property or home that has not been properly maintained for an extended period will be subject to inspection by the Company's Management.

Provided such a report is filed within 24 hours from the date/time of the service performed, the Company will commit to redo the service free of charge until the Customer is satisfied with the results under reasonable circumstances. Such commitment is subject to inspection by the Company's Management and will be assessed on a case - by - case basis. No refund of any kind will be provided for a completed service.

Accidental Damages

Any reports of damages caused by our Workers during a Service must be reported within 24 hours from the date the service was completed to be valid and considered. The Company will take reasonable means necessary to correct, fix, repair, or replace the damaged items. These reports must be initiated online through our Web Interface at www.divinacleaningservices.com.

The Customer must provide detailed information about the incident and the item in question. Please note that the Company cannot be held responsible for any damages when it is evident that the damaged item in question is caused by the Customer's lack of care or maintenance. This includes floors, area rugs, carpets, windows, walls, appliances, doors, door frames, sills, collectibles, or any other item placed in unsafe conditions.

Privacy Policy

The Customer acknowledges that any information provided to the Company may be used for the purpose of providing the Service. Unless required by law, the Company agrees not to share any information provided by the Customer with third parties not directly involved in the provision of the Service. Changes to this Agreement

The Company reserves the right to update or modify the Terms and Conditions: The Company may change the terms and conditions at any time without prior notice.

Effect of changes after 24 hours from posting on the website: Changes become effective 24 hours after being posted on the website.

Law and Jurisdiction

Application of the law of the State of Connecticut and jurisdiction of the courts of New Haven County: In case of dispute, the law of the State of Connecticut and the courts of New Haven County shall apply.
